The Prosecution Services Unit (PSU) is responsible for providing legal services in the regulation of all health care boards and councils. PSU takes administrative action against healthcare practitioners for violations of the licensee’s practice act.
Your Specific Responsibilities:
Incumbent in this position provides leadership and supervision to attorneys within the Office of the General Counsel, Prosecution Services Unit. Responsible for the supervision of staff Including appraisals, planning and directing their work, approving leave, having the authority for hiring, and taking disciplinary action or effectively recommending such actions.
Duties within the team include:
- Manages caseloads by reviewing and coordinating work.
- Oversees quality and timeliness of caseload process through individual and team case triaging and auditing and management.
- Utilizes computer case management system to track activities necessary to bring cases to final resolution.
- Communicates with attorneys and staff to keep them informed of new and/or revised procedures and conducts or arranges for training to assist attorneys and staff in their assigned duties and responsibilities.
- Provides information and reports on assigned cases.
- Renders legal opinions and advice on handling cases before DOAH.
- Submits timely Daily Activity Reports.
- Reviews and research proposed or pending legislation.
- Assists in the effective presentation of cases before DOAH; provides timely report and assessment of team members.
- Prepares recommended action for Probable Cause Panels to include dismissals, letters of guidance or Administrative Complaints; presents cases before the probable cause panels.
- Drafts pleadings, discovery and legal memoranda; represents the Department before the Division of Administrative Hearings.
- Maintains case files, reviews investigative and legal files; responds to inquiries from counsel, the public and other agencies regarding current cases, agency policy and public record requests.
- Prepares, and presents as needed, cases before the boards
- Supervises direct reports including motivating, training, providing guidance, and direction. Develops expectations and meets with staff regularly to discuss performance, complete performance reviews, and discipline action, if needed. Maintains vacation and work schedules to ensure proper coverage and completes timesheets. Ensures all staff complete required training and are offered additional training.
Qualifications:
- Juris Doctorate from a law school accredited by the American Bar Association
- Membership in the Florida Bar, or membership within 12 months of accepting a position
