What you will do:
The Department of Children and Families, Office of General Counsel, is seeking to hire a Senior Attorney to be based out of our Tampa office. The primary duties of this position are to represent the Florida Department of Children and Families under the Regional Legal Counsel and assist in planning, managing, implementing, and operations of the legal services performed in the circuit(s) and region. Duties include but are not limited to:
- Knowledge and understanding of Chapter 402 and Chapter 120 of the Florida Statutes.
- Knowledge and understanding of the Rules contained in 65C-20, 65C-22, and 65C-25 of the Florida Administrative Code regulating child care.
- Responsible for collaborating with the Office of Licensing, Child Care Regulation, and with Region Child Care Regulation staff to facilitate program objectives.
- Responsible for meeting with the Office of Licensing, Region Child Care Regulation staff, to provide legal guidance on requests for administrative action.
- Responsible for review and drafting of child care administrative complaints and emergency suspension orders.
- Responsible for review and drafting of child care injunctions.
- Responsible for review of child care regulation legal issues and providing legal guidance to Region Child Care Regulation staff.
- Serve as legal counsel for the Department in formal and informal child care regulation hearings in front of the Division of Administrative Hearings (DOAH) and the Department’s hearing officers.
- Serve as legal counsel for the Department in appeals involving child care regulation.
- Other duties regarding child care regulation as deemed necessary in the best interests of the Region, Department, and State as assigned.
About the Office of the General Counsel:
The lawyers of the Office of the General Counsel provide legal advice and counsel on Department initiatives concerning child welfare, substance abuse, mental health, family development and reunification, and other Department services. The General Counsel provides legal counsel to the Secretary, executive leadership and management, and all Department employees throughout sixteen (16) locations statewide. The Office also provides legal advice regarding the Department, and its initiatives, to the Governor, Cabinet members, the Legislature, the Judiciary, and other state and local governmental agencies.
Qualifications:
- Juris Doctorate
- Minimum of 2 years of bar admission
- Licensed to practice law in the State of Florida.
Preferred, but not required:
- Experience in litigation and/or administrative law
- Bilingual, Spanish Speaking

What is OPS employment?
OPS employment is a temporary employer/employee relationship used for accomplishing short term or intermittent tasks. OPS employees are at-will employees and are subject to actions such as pay changes, changes to work assignment, and terminations at the pleasure of the agency head or designee.
OPS employees do not serve probationary periods or become permanent in their positions because they serve at the pleasure of the agency head.
