California Office of Patients’ Rights (COPR)
COPR is contracted by the Department of State Hospitals and working with Department of Healthcare Services to ensure that the treatment and legal rights of people receiving mental health treatment are maintained.
PURPOSE OF THE JOB
The Patients’ Rights Advocate (PRA) provides Technical Assistance
and training supports to the county title 9 advocacy programs which include support to a list serve, intake from the county PRAs, assistance in writing informational notices and other related deliverables. . The PRA works under the direction of the Supervising Advocate Specialist assigned to the county program of COPR.
JOB RESPONSIBLITIES
Essential functions are the job responsibilities an employee must be able to perform, with or without reasonable accommodations. The County Patients’ Rights Advocate functions include:
· Provide technical assistance and advocacy support to incoming requests form county title 9 PRAs,
· Assist in County PRA program reviews.
· Assist in planning advocacy trainings for county title 9 PRAs,
· Work closely with the Office Manager and Supervisor for annual training conferences,
· Attend various statewide meetings as directed by supervisor
· Write informational papers on current and updated laws as the apply to the county PRAs.
· Assisting County Patients' Rights Advocate’s with complex cases involving multiple parties with complex factual issues. This includes, as necessary in a particular case, but is not limited to:
a) Maintaining written and electronic case files in accords with Disability Rights protocols.
b) Interviewing hospital staff, clients and witnesses and reviewing agency notices and records and other documents to ascertain the facts.
c) Researching the applicable law, including cases, statutes, regulations, or other applicable authorities.
d) Applying COPR/ Disability Rights California’s standards and criteria to determine what level of assistance is appropriate for each contact;
e) Evaluating various options and possible courses of conduct, and developing and implementing options and case strategies that are appropriate given the law and the facts;
f) Drafting correspondence;
g) Negotiating with agencies and other parties;
· Assisting with the county appeals
· Creating and preparing written resource materials and conducting outreach to, and education and training of, consumers, community groups, advocates, and others, particularly those from traditionally underserved communities.
· Participating with other agencies and organizations to address recurring problems and issues affecting people with disabilities.
· Coordinating or leading efforts to one or more; specified policies, bills, regulations, articles, reports, or projects. This could include coordinating or leading participation on inter-agency task forces and commissions, taking the lead on analyzing or drafting language for bills and proposed regulations, testifying before legislative and administrative bodies, and coordinating or leading preparation on reports, articles, and special projects.
· Taking primary responsibility for coordinating a component of COPR’s advocacy functions, which could include, for example, chairing or co-chairing a workgroup, or coordinating monitoring activities and assisting in the delivery of a focused training;
· Travel to county advocacy programs to provide onsite technical assistance and to conduct program reviews;
· Teaming with and providing training, support and technical assistance to other COPR advocacy staff in area(s) of expertise for purposes of mentoring and assisting them in their advocacy work.; and
· Performing other duties as assigned.
SUPERVISORY RESPONSIBLITIES
This position has no supervisory responsibilities
MINIMUM QUALIFICATIONS
Education and Experience
Bachelor's Degree in a related field. Four years direct life experience as a mental health consumer or four years’ experience as a consumer advocate may be substituted in lieu of the Bachelor’s Degree (i.e., social work, counseling, self-help).
· Two years’ experience as a consumer advocate within the social, human service, government, or health care environment. (If using experience in lieu of Bachelor's degree, this qualification has been met).
· Working knowledge and understanding of the mental health and criminal justice systems.
· Experience utilizing Microsoft Word/Windows or comparable word processing program on a personal computer.
· Experience working with and a sensitivity to the rights of persons with disabilities.
· Experience working with and a sensitivity to persons from multi-ethnic communities.
Licenses / Certificates
This position has no licenses or certificates requirements.
Required to complete online training within 90 days of employment.
PREFERRED QUALIFICATIONS
- Experience in direct advocacy for persons with psychiatric disabilities.
- A working knowledge of the legal, civil and service rights of persons with psychiatric disabilities in California.
- Ability to speak Spanish or an Asian language, or American Sign Language (ASL).
- Experience with the mental health system as a current or former consumer/or with family member, significant other.
- Contacts with disability organizations and/or within disability communities.
- Contacts with multi-ethnic organizations and/or within multi-ethnic communities.
WORKING CONDITIONS
The following describes general working conditions and requirements of the job, which can be performed with or without disability related reasonable accommodations. Duties are performed in a two-person or shared office environment. May go into county facilities to observe resident living environments and provide direct advocacy services. Duties regularly require sitting using computer equipment and talking or hearing. Duties occasional require periods of standing, stooping, kneeling, and crouching primarily related to processing paperwork. Weights to be lifted and/or moved of filing boxes and other packages up to 25 pounds are occasionally encountered.
TRAVEL REQUIREMENTS
Ability to travel infrequently for activities such as training, site coverage, and unit meetings, up to 10% of the time.
