Our Organization and Mission: The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.
Pay: $60,000 - $65,000 Annually
Position Summary: This position is in the Criminal Appeals Unit. We are seeking applicants who have a strong interest in conducting legal research, honing their writing skills, having vibrant discussions of the law, in having the opportunity to argue in the appellate courts, and who seek to work on behalf of the people of the State of Florida. The Attorney General's Criminal Appeals Division cultivates a collegial environment where attorneys are encouraged to discuss their cases and share ideas. All attorneys are assigned a mentor and have access to free, in-house continuing legal education.
Qualifications: Admission to the Florida Bar and two years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings.
The required legal experience must be from the practice of law in a state or territory of the United States.
Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.
The Work You Will Do: The Florida Attorney General's Criminal Appeals Division strives to keep in place the criminal convictions and sentences obtained by state prosecutors in the trial courts. By having attorneys who specialize in appellate work, the Attorney General is able to ensure that the large volume of criminal appeals is handled professionally and efficiently. The Criminal Appeals Bureau maintains a high volume of cases every year. In addition to direct criminal appeals, the Bureau handles sexually violent predator commitment appeals, state post-conviction appeals, extraordinary writs, state appeals to adverse rulings, and inmate challenges to state convictions in federal court. Cases range from relatively minor sentencing and post-conviction appeals to complicated white-collar crime, homicide, child abuse, and sexual assault cases. Often, the cases involve constitutional or statutory construction issues and can present matters of first impression. While the majority of the cases impact only the defendants and victims involved, any given case may result in new published law that has a significant impact on law enforcement procedures and on procedures for criminal trials and sentencing hearings throughout the state.
Criminal Appeals attorneys must provide effective and ethical representation in all cases. In each case, the attorney must read the trial transcripts and other pertinent documents, conduct legal research on each of the appellant's claims, and draft an argument explaining why the State of Florida should prevail. Attorneys in Criminal Appeals regularly present oral arguments before the Florida district courts of appeal, the Florida Supreme Court, and the United States Eleventh Circuit Court of Appeals.
