This is an administrative Hearing Officer position that conducts administrative hearings related to DCF and APD actions. The hearing officer must afford a fair and complete hearing and conduct the proceeding so that the record affirmatively shows that the hearing has met all requirements of the law. The hearing is a formal hearing under the Administrative Procedures Act, Chapter 120 F.S. and federal program requirements, as it often involves disputes of facts requiring specific evidentiary determinations. The Hearing Officer must provide the petitioner a meaningful opportunity to be heard. The Hearing Officer has the responsibility of formulating a Department or Agency final action. This could include granting the appeal and ordering corrective action or denying the appeal and affirming the Department or Agency action. The incumbent must have a strong knowledge of the programs and policies that come before him/her. The different types of hearings conducted by this position are: fair, disqualification and nursing home discharge hearings. The incumbent will conduct hearings statewide primarily telephonically, and in-person when requested by the petitioner. The incumbent must travel to the office in Tallahassee or other locations, as required. The incumbent will conduct hearings statewide via telephone and face-to-face in an assigned geographical area. This position must be able to travel to the office in Tallahassee or other locations as required.
EXAMPLES OF WORK
•Conducts the hearing following statutory guidelines between 8:00 am and 5:00 pm Monday through Friday. Administers oaths, establishes the burden and standard of proof required of the parties at the hearing. Develops the record, rules on motions and the admissibility of evidence.
•Must have the program knowledge to bring into the record facts necessary to resolve the issue(s) under review. Researches, reviews, analyzes, and maintains an up-to-date knowledge of the various programs, including pertinent statutes, court decisions, Florida Administrative Code, federal regulations and the agencies’ interpretation of such authorities. Monitors the agencies’ implementation of these authorities to determine the correctness of the action.
•Reviews hearing requests for jurisdiction, facilitates settlement negotiations, issues orders for prehearing conferences and discovery. Schedules the hearing, assuring all of the requirements of law have been met. Issues and rules on subpoena requests.
•Prepares a written decision, setting forth in a concise manner, the facts of the cases and the effect of the application of law to those facts. This decision must be prepared in a manner prescribed by law to pass a stringent review in the District Courts of Appeal. The decision must respond to proposed findings of fact and arguments submitted by each party.
•Holds hearings in an assigned geographical area and must travel statewide as assigned. Must travel to the office in Tallahassee or to other locations for staff meetings as required.
•Performs other related duties as assigned.

BACKGROUND SCREENING REQUIREMENT:
It is the policy of the Florida Department of Children and Families that any applicant being considered for employment must successfully complete a State and National criminal history check as a condition of employment before beginning employment, and also be screened in accordance with the requirements of Chapter 435, F.S., and, if applicable, Chapter 408, F.S.
