The Miami-Dade State Attorney’s Office is seeking an experienced criminal trial attorney to fill the position of Assistant State Attorney in our Mental Health Unit. Admission, in good standing, to The Florida Bar is required. The applicant selected for this position will represent the 11th Judicial Circuit of Florida in various mental health proceedings in several different venues and matters and will be responsible for working with the other Assistant State Attorneys assigned to the Office’s Mental Health Unit.
The Applicant’s duties, among other things, may include primary responsibility for handling cases where a Defendant has been adjudicated Incompetent to Proceed or Not Guilty by Reason of Insanity. In those cases, the Applicant would represent the Office at Daily Calendar in the following types of hearings:
Placement Hearings upon discharge from the State Hospital
Recommitment Hearings
Restoration to Competency
Conditional Release status dates
Violations of Conditional Release
Dismissal due to continued Incompetence
Involuntary Examination Orders pursuant to Florida Statutes Chapter 394 or Petitions pursuant to Florida Statutes, Chapter 393
The Applicant would also serve as back-up coverage for other attorneys in the Office’s Mental Health Unit and would assist with Baker Act Hearings, Felony Mental Health Diversion, Veteran’s Court and Misdemeanor Mental Health Diversion.
Preference will be given to lawyers who have experience in handling cases involving mental health or related fields.
